REFUND AND RETURNS POLICY

Driven By Light Photography (“Driven By Light,” “we,” “us,” or “our”) provides photography services that are scheduled, customized, and reserved specifically for each client.

Because photography sessions require reserving a specific date and time and may involve preparation, travel, equipment, editing, and other costs, the following Refund and Returns Policy applies to photography bookings unless a separate written agreement signed by Driven By Light states otherwise.

1. PHOTOGRAPHY SERVICES ARE NOT RETURNABLE

Photography services are not physical products and therefore cannot be “returned.”

Once a photography session has been booked and the required payment or deposit has been received, the date and time may be reserved specifically for the client.

Refund eligibility is therefore determined by this policy and the client’s signed photography agreement.

2. DEPOSITS AND RETAINERS ARE NON-REFUNDABLE

All deposits, booking fees, retainers, or other amounts identified as non-refundable in the client’s photography agreement are non-refundable.

The purpose of the deposit or retainer is to reserve the client’s photography date and time and to compensate Driven By Light for reserving that availability and beginning preparation for the session.

A client’s cancellation, failure to attend, change of plans, or failure to provide required information does not automatically entitle the client to a refund of a non-refundable deposit or retainer.

3. CANCELLATIONS BY THE CLIENT

If a client cancels a scheduled photography session, the deposit or retainer will remain non-refundable.

Any additional amount paid beyond the non-refundable deposit or retainer may be eligible for a refund depending on the circumstances and the terms of the client’s signed agreement.

Driven By Light reserves the right to deduct from any applicable refund amounts that are non-refundable under the contract or that have already been earned or incurred in connection with the booking, to the extent permitted by law.

4. RESCHEDULING

A client may request to reschedule a photography session.

Requests to reschedule should be made at least 48 hours before the scheduled session time, unless otherwise stated in the client’s signed agreement.

Rescheduling requests received with at least 48 hours’ notice may be accommodated based on Driven By Light’s availability.

Rescheduling is not guaranteed until a new date and time have been confirmed by Driven By Light.

Repeated rescheduling requests may be subject to additional restrictions or fees where stated in the photography agreement.

5. LATE CANCELLATIONS AND NO-SHOWS

A cancellation made less than 48 hours before the scheduled session, or a failure to appear for a scheduled session without adequate notice, may be treated as a late cancellation or no-show.

Late cancellations and no-shows generally result in the loss of the non-refundable deposit or retainer and may result in additional amounts being due under the client’s signed agreement.

A client who arrives significantly late may receive reduced shooting time because the session may still need to end at the originally scheduled time.

A significant delay may also result in the session being treated as partially or fully forfeited, depending on the circumstances.

6. WEATHER, EMERGENCIES, AND UNFORESEEN CIRCUMSTANCES

For outdoor photography sessions, severe weather or unsafe conditions may require a session to be rescheduled.

When reasonably possible, Driven By Light will work with the client to select another available date.

Weather-related rescheduling does not automatically create a right to a refund of a non-refundable deposit or retainer.

Driven By Light may also reschedule a session when circumstances outside our reasonable control make it unsafe or impractical to perform the service, including severe weather, natural disasters, government restrictions, emergencies, transportation disruptions, equipment failure, venue restrictions, or other circumstances beyond our reasonable control.

7. CANCELLATION BY DRIVEN BY LIGHT

Driven By Light reserves the right to cancel or reschedule a photography session when necessary due to illness, emergency, unsafe conditions, equipment issues, unforeseen circumstances, or other circumstances that prevent the photographer from reasonably performing the service.

When Driven By Light cancels a session for reasons within its control, we will make reasonable efforts to offer a replacement date.

If Driven By Light is unable to provide the contracted service and a mutually acceptable replacement date cannot be arranged, the client may be entitled to a refund of amounts paid for services that were not provided, subject to the terms of the signed agreement and applicable law.

Nothing in this policy limits rights that cannot legally be waived.

8. QUALITY CONCERNS

Driven By Light takes pride in providing professional photography services.

Photography involves artistic judgment, creative style, lighting conditions, posing, composition, editing, environmental circumstances, and other factors.

A client’s personal preference regarding artistic style, posing, editing, image selection, or creative direction does not automatically constitute a defect or basis for a refund when the agreed photography service has been substantially performed.

If a client believes there is a genuine service issue, the client should contact Driven By Light promptly so that the concern can be reviewed and, where reasonably possible, corrected.

9. PHOTOGRAPH DELIVERY

Estimated delivery times may vary depending on the type of photography session, number of images, editing requirements, scheduling, and other circumstances.

Delivery delays caused by circumstances outside Driven By Light’s reasonable control do not automatically entitle a client to a refund.

10. DIGITAL PHOTOGRAPHS

Digital photographs delivered to a client are not returnable.

Once digital images have been delivered, a refund is generally not available solely because the client changes their mind or no longer wants the purchased service.

Clients are encouraged to review package details, included services, deliverables, and pricing before booking.

11. THIRD-PARTY PAYMENT PROCESSORS

Payments may be processed through third-party payment providers.

A payment processor may have separate terms, policies, or dispute procedures. However, a payment dispute submitted through a payment processor does not automatically override the terms of the client’s signed photography agreement or this Refund and Returns Policy.

Clients should contact Driven By Light directly before initiating a payment dispute whenever possible.

12. CHARGEBACKS AND PAYMENT DISPUTES

Clients agree to contact Driven By Light to attempt to resolve legitimate billing or service concerns before initiating a chargeback or payment dispute, where reasonably possible.

Fraudulent or improper chargebacks may be disputed using the applicable booking records, contracts, communications, invoices, proof of service, and other documentation.

Nothing in this section is intended to prevent a consumer from exercising a legal right that cannot lawfully be waived.

13. CONTRACT CONTROLS

This Refund and Returns Policy is intended to supplement the photography agreement provided to and accepted by the client.

If there is a conflict between this policy and a separately signed written photography agreement, the terms of the signed agreement will control to the extent permitted by applicable law.

By booking a photography session with Driven By Light, the client acknowledges that they have had an opportunity to review the applicable booking terms, including cancellation and rescheduling requirements.

14. EXCEPTIONS REQUIRED BY LAW

Nothing in this policy is intended to exclude, restrict, or waive any refund, cancellation, consumer-protection, or other right that cannot legally be excluded or waived under applicable law.

Where applicable law requires a refund or other remedy, Driven By Light will comply with that requirement.

Acknowledgment: By booking a photography session, the client acknowledges that they have reviewed the applicable photography agreement and this Refund and Returns Policy and agree to be bound by them, subject to applicable law.
