This Agreement establishes the terms for professional photography services provided by Michael /
Driven By Light Photography and the undersigned Client.

Your photoshoot type, selected package, date, and start/end time are determined by your appointment booking and are displayed in the booking confirmation above this agreement.

1. PHOTOGRAPHY SERVICES

The Photographer agrees to provide professional photography services for the Client as described below:

Any services, products, additional editing, prints, albums, additional images, travel, or other items not specifically included above may be subject to additional fees.

2. PAYMENT

Retainer / Deposit: 50% deposit due to secure the booking, remaining 50% due on the day of the session or before

A retainer/deposit may be required to reserve the Client’s date and time. Unless otherwise agreed in writing, the Photographer is not required to reserve a date until the required retainer and signed Agreement have been received.

The Client is responsible for payment of all agreed-upon fees. Additional services or expenses approved by the Client may be added to the final balance.

3. CANCELLATION & RESCHEDULING

Cancellation Policy

If the Client cancels the scheduled photoshoot for any reason, the deposit/retainer paid to reserve the date is non-refundable and will not be returned.

The deposit compensates the Photographer for reserving the date and turning away other potential bookings.

Rescheduling Policy

If the Client needs to reschedule the photoshoot, they must notify the Photographer and request a new date at least 48 hours before the originally scheduled photoshoot time.

Rescheduling requests made less than 48 hours in advance may be treated as a cancellation, and the deposit/retainer may be forfeited.

Rescheduling is subject to the Photographer’s availability. A new date and time are not considered confirmed until the Photographer has agreed to the new date.

Any additional terms or fees related to rescheduling must be agreed upon in writing.

Cancellation Policy: Deposit/retainer is non-refundable if the Client cancels.

Rescheduling Notice: At least 48 hours’ notice is required before the scheduled session.

New Date: Subject to Photographer availability and confirmation.

4. PHOTOGRAPHER CANCELLATION / EMERGENCY

If the Photographer is unable to perform the services because of serious illness, emergency, accident, equipment failure, unsafe conditions, natural disaster, or another circumstance beyond the Photographer’s reasonable control, the Photographer will make reasonable efforts to reschedule the session.

The Photographer’s liability for failure to perform services shall be limited to the amount actually paid by the Client for the affected photography services, to the extent permitted by applicable law.

5. PHOTO DELIVERY

Final photographs will be delivered through a method selected by the Photographer, which may include an online gallery, digital download, cloud storage, or another electronic delivery method.

• The Photographer will select the final images and determine which photographs are suitable for delivery.

• The Photographer will perform professional editing consistent with the Photographer’s artistic style.

• RAW/unprocessed files will not be provided unless separately agreed in writing.

• Unedited photographs will not be provided.

• The Client may request reasonable corrections to final images, but major re-editing or extensive alterations may result in an additional fee.

6. ARTISTIC STYLE & CREATIVE CONTROL

The Client acknowledges that they have reviewed the Photographer’s portfolio and understand the Photographer’s artistic style.

The Client agrees that the Photographer will have reasonable creative control over composition, posing, lighting, editing, color, cropping, and final image selection.

The Photographer will make reasonable efforts to honor specific requests made by the Client but cannot guarantee a particular artistic result.

7. COPYRIGHT & OWNERSHIP

The Photographer retains copyright ownership of photographs created during the photoshoot unless a separate written copyright transfer agreement is signed.

Payment for photography services does not automatically transfer copyright ownership to the Client.

The Client receives a personal-use license to download, print, display, and share the delivered photographs for personal, non-commercial purposes, provided the photographs are not materially altered or used to promote another business, product, service, or commercial activity without written permission.

Commercial usage, advertising, brand campaigns, business promotion, resale, licensing, or other commercial uses may require a separate commercial license.

The Client may not sell, license, claim ownership of, or commercially exploit the photographs without written permission from the Photographer.

8. PUBLICITY, PORTFOLIO & SOCIAL MEDIA RELEASE

The Photographer regularly uses photographs from completed sessions to advertise and promote Driven By Light Photography, including through Instagram, Facebook, TikTok, websites, online portfolios, business pages, printed promotional materials, advertisements, marketing materials, photography competitions or publications, and other promotional channels operated by or on behalf of Driven By Light Photography.

Because photographs may contain the Client’s name, face, likeness, or other identifying characteristics, the Client must make a clear selection below.

I give Driven By Light Photography and Michael permission to use photographs and/or video of me created during my session for portfolio, advertising, promotional, social media, website, marketing, and other lawful business purposes.

I understand that these images may be publicly displayed online or in other promotional materials without additional payment to me.

NO — I DO NOT CONSENT

I do not give Driven By Light Photography permission to publicly use photographs or video in which I am identifiable for portfolio, advertising, promotional, social media, website, marketing, or other commercial promotional purposes.

I understand that this choice does not prevent the Photographer from delivering and retaining my photographs as part of providing the contracted photography services.

The Client may change their publicity preference by providing written notice to the Photographer.

Such change will apply to future promotional uses to the extent reasonably practicable, but the Photographer cannot guarantee the removal of materials that have already been printed, published, distributed, reposted, or otherwise placed in circulation.

9. CLIENT-PROVIDED CONTENT & THIRD-PARTY RIGHTS

If the Client provides logos, artwork, music, photographs, trademarks, names, or other materials to the Photographer, the Client represents that they have the right to provide those materials and authorize their use in connection with the photography services.

The Client is responsible for obtaining any necessary permission from third parties for materials they provide.

10. CLIENT RESPONSIBILITIES

The Client agrees to:

• Arrive on time for the scheduled session.

• Communicate relevant requests or concerns before the photoshoot when reasonably possible.

• Follow reasonable safety instructions.

• Inform the Photographer of any special circumstances that may affect the session.

• Ensure that any children or other individuals participating in the session are appropriately supervised.

• Obtain permission for photography at locations where permission is required.

Late arrival may reduce the amount of available shooting time and may not result in an extension of the scheduled session.

11. WEATHER & OUTDOOR SESSIONS

For outdoor sessions, the Photographer may recommend rescheduling because of severe weather, unsafe conditions, or circumstances that could negatively affect the session.

The Photographer will make reasonable efforts to communicate with the Client regarding weather related changes.

12. PERSONAL SAFETY & PROPERTY

The Client understands that photography sessions may take place outdoors, at events, around vehicles, or in other environments where ordinary risks may exist.

The Client is responsible for their own personal belongings and property.

The Photographer will take reasonable care but is not responsible for loss or damage to Client property except to the extent caused by the Photographer’s negligence or as otherwise required by law.

13. IMAGE STORAGE

The Photographer may maintain copies of delivered photographs for portfolio, business, backup, archival, or other legitimate purposes.

The Client understands that the Photographer does not guarantee permanent storage of photographs indefinitely.

The Client is encouraged to download and safely back up all delivered photographs.

14. LIMITATION OF LIABILITY

To the extent permitted by applicable law, the Photographer’s total liability arising from the photography services or this Agreement shall not exceed the total amount actually paid by the Client for the affected photography services.

Nothing in this Agreement is intended to waive rights or protections that cannot legally be waived.

15. AGREEMENT TO TERMS

The Client confirms that they have had the opportunity to read this Agreement and ask questions before signing.

The Client understands that this Agreement represents the understanding between the Client and Photographer regarding the photography services described above.

Any changes to this Agreement should be made in writing and agreed upon by both parties.

16. GOVERNING LAW

This Agreement shall be governed by and interpreted under the laws of the State of Florida, without regard to conflict-of-law principles, to the extent permitted by applicable law.
